Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cyclenetix Secure platform and related services provided by Cyclenetix Labs, Inc.("Cyclenetix Labs", "we", "us"). By creating an account, deploying our agent, or otherwise using the service, you agree to these Terms.

1. The Service

Cyclenetix Secure provides remote monitoring and management, patching, remote access, automation and security capabilities for endpoints you are authorized to manage. We may update, improve or modify features over time.

2. Agent Deployment License

We grant you a limited, non-exclusive, non-transferable license to deploy and use our agent solely on endpoints you own or are authorized to administer, and solely in connection with the service. You must not reverse engineer, tamper with, or redistribute the agent.

3. Permitted Use

  • You are responsible for obtaining all necessary authorizations to monitor and manage the endpoints you enroll.
  • You must not use the service for unlawful purposes, to access systems without authorization, or in violation of any applicable law.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Service Level Commitment

We target a 99.9% monthly uptime for the platform, excluding scheduled maintenance and events beyond our reasonable control. Specific service-level terms may be provided in a separate agreement for enterprise customers.

5. Fees

Paid plans are billed per technician on a monthly or annual basis as described at checkout. Fees are non-refundable except as required by law or expressly stated in a written agreement.

6. Limitation of Liability

To the maximum extent permitted by law, Cyclenetix Labs shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising out of or related to the service. Our aggregate liability shall not exceed the fees paid by you in the twelve months preceding the claim.

7. Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms. Upon termination, your right to use the service ends and we will handle your data in accordance with our Privacy Policy.

8. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. The exclusive venue for disputes shall be the state and federal courts located in California.
